Get informed before you make any decisions…
Here are a couple examples of how informed decision making can save you a LOT of time, energy, and money down the road:
John and Jane have separated and the divorce has been moving along. John decides to keep the house and Jane agrees. At mediation, they sign a legal document that locks the terms in place. John gets the house with any and all encumbrances and Jane gets all the stocks. 6 months later, John goes to sell the home. Some interested buyers write and offer and he is excited. 2 weeks down the road, he learns that there is a $125,000 tax lean on the property that must be paid out of proceeds. Jane never told him about the lean even though she knew about it. He only has $50,000 in equity so he takes her back to court and loses. He is now forced to keep the house, which puts him in a jeopardy of being sued by the buyers or he can short sell and take the hit financially and on his credit. What should he do?
